Prosecutors Hope New $1 Million Bail Will Keep Cheryl Luchetta in Jail

Prosecutors are hoping a higher bail set Monday will make it more difficult for an Elmhurst mom to get out of jail while she awaits trial on charges she tried to kill her son.

DuPage County Judge Daniel Guerin increased Cheryl Luchetta's bail to $1 million on Monday after hearing an audio recording of her threatening her ex-husband and demanded to speak to her son, The Daily Herald is reporting.

Prosecutors say she has violated multiple times a court order prohibiting her from contacting them. Guerin also ordered her to stay more than a mile from the boy if she should happen to be released.

Her erratic behavior has landed her in segregation multiple times while in jail, according to reports. She has used racial epithets toward other inmates and at least one jail worker, threw salt in the face of an inmate, threatened to break an inmate's neck and pulled down her pants while making a crude remark to an inmate.

Prosecutors say she is at greater risk of causing harm to her ex-husband and son than ever before.

“Now that the divorce is complete and she has lost custody … (Luchetta) poses a grave risk to both individuals,” prosecutors said in a motion filed last week.

Luchetta is accused of giving her son a mix of Tylenol PM, valium and diazepam, then slitting her own throat inside the family’s Elmhurst residence in June. She awoke the next morning and called 911 to tell police an ex-boyfriend broke into the home, poisoned her son and cut her neck, according to prosecutors.

She has pleaded not guilty to attempted murder and aggravated battery to a child.
