Not Guilty Plea by Mother Accused of Drugging 7-year-old Son

A grand jury this week indicted Cheryl Luchetta on charges of  and aggravated battery to a child tied to a June incident where, according to prosecutors, she drugged her son and then cut her own throat.

Luchetta pleaded not guilty to the charges during a Wednesday court appearance. She remains in DuPage County Jail on $300,000 bail.

Prosecutors allege that on June 8, Luchetta, 41, gave her 7-year-old son a mix of drugs and then downed nine months' worth of her own prescription medication and slit her throat. She called 911 on June 9 after waking up to find her son unconscious, according to prosecutors, who also said the boy was given a mix of valium, diazepam and Tylenol PM.

Judge Daniel Guerin has signed off—over objections by Luchetta's attorney—on a request by prosecutors to have Luchetta undergo a In court documents, prosecutors claim Luchetta said she "was depressed and wanted to end her life, but could not bear to be without (her son)."

The records also indicate Luchetta took medications for anxiety and bipolar disorder in the last 12 years, and was hospitalized for psychological treatment five years ago.

Also this week, a judge in Luchetta's divorce case that prevents her from having contact with her son or her husband, Matthew. He took out an order of protection against Luchetta shortly after learning about their son's injuries and Luchetta's reported involvement.

In his petition for the protective order, Matthew Luchetta described Cheryl as "suicidal." In May, his stated Luchetta has "mental and/or emotional" disability and had shown "inconsistent and reactive" behavior during their marriage.
