$300,000 Bail Upheld for Elmhurst Mom Accused of Attempting to Kill Her Son

Cheryl Luchetta had been hospitalized since early June, when prosecutors say she drugged her 7-year-old.

The Elmhurst mother and then cutting her own throat made her first court appearance Friday afternoon during a brief hearing before Judge Michael Wolfe, who upheld the $300,000 bail amount attached to an arrest warrant issued two weeks ago.

Prosecutors told Wolfe that Cheryl Luchetta on June 8 gave her son a mixture of valium, diazepam and Tylenol PM, and then took nine months' worth of her own valium prescription before cutting her throat.

Luchetta, who suffered a superficial wound to the neck, apparently vomited her pills before waking up the next morning. She then called 911 and told an emergency dispatcher that she and her son were victims of a home invasion by a suspect who forced the boy to take the medication, prosecutors said.

The boy is out of the hospital and living with his father.

If Luchetta were to post bond, she is under a court order to stay 2,000 feet from the Elmhurst condo where she lived and from her husband's residence. The judge also upheld a no-contact order that keeps Luchetta from the boy and her husband.

She would also be required to wear a GPS monitor if released, according to prosecutors.

It was not immediately clear if Luchetta would be under any special monitoring at the DuPage County Jail or when she will return to court.

Luchetta, 41, had been hospitalized since June 9; police did not arrest her until her condition improved enough to be released from treatment.

No motive has been discussed publicly, but court records show Luchetta has been involved in a with her husband, Matthew. He took out an order of protection against Luchetta shortly after learning about their son's injuries and Luchetta's reported involvement.

In his petition for the protective order, Matthew Luchetta described Cheryl as "suicidal." In May, his divorce counterclaim states Luchetta has "mental and/or emotional" disability and had shown "inconsistent and reactive" behavior during their marriage.
