Man Shot at C.D. Peacock in Oak Brook Is Sentenced

The State asked for the maximum sentence of 15 years, but he could be out after four if paroled.

The man who was shot by a security guard after attempting to steal jewelry from C.D. Peacock at Oakbrook Center Mall last summer has been sentenced to eight years in prison, according to DuPage County State's Attorney Robert Berlin.

Levert Jones, 25, of Detroit, entered a blind plea of guilty Thursday to one count of attempted armed robbery, a Class 1 felony, in front of Judge Blanche Hill Fawell. The State had asked for the maximum sentence of 15 years.    

Jones and two accomplices entered the store at about 3:45 p.m. June 23. Jones pulled a small sledgehammer from his waistband and began smashing the glass merchandise cases, according to the complaint. A store security guard pulled his weapon and ordered Jones to stop what he was doing and kneel on the ground.

After initially complying with the security guard’s orders, Jones reportedly tried to get up when the security guard attempted to handcuff him. The guard shot him in the abdomen. Oak Brook police arrived at the scene shortly after, and Jones was taken to the hospital. 

Jones’s alleged accomplices left the store, and then left the mall in a vehicle they had allegedly stolen from the mall parking lot.

“This type of outrageous behavior will not be tolerated in DuPage County,” Berlin said, thanking the Oak Brook Police Department and Assistant State's Attorney James Scaliatine. 

Jones will be required to serve 50 percent of his sentence before being eligible for parole.
