Berwyn Man Arrested in Elmhurst for Possession of Cocaine with Intent to Deliver

Police also report arrests for DUI, property damage and possession of cannabis.

Possession of a Cocaine with Intent to Deliver

Nicholas Diaz, 47, 1611 Clarence Ave., Berwyn, was arrested and charged with possession of cannabis, possession of a controlled substance with intent to deliver and on a warrant for delivery of a controlled substance after police pulled over his red Dodge Ram on the 500 block of West Lake Street at 2:15 p.m. Jan. 9. Police found 15 small baggies of cocaine in the ashtray. Diaz gave consent for a search of his home, where police found two scales, 32 grams of cocaine, cutting powder, baggies and $493. The arrest was a result of a 10-month investigation, where Diaz was suspected of selling cocaine from his place of employment in Elmhurst. He was taken to DuPage County Jail.

Disorderly Conduct

Florencio Sanchez, 29, 1043 Adelia St., Downers Grove, was arrested on multiple charges after an incident at Burger King, 176 E. Butterfield Road, at 12:10 p.m. Jan. 9. Police received a call for an accident at the Burger King. The manager said a man came into the restaurant and told him he hit the overhang at the drive-through with his truck. He said he told him he didn't have a drivers license but would fix the damage. He then left the restaurant. He came back when police were there, and he was sitting in the passenger seat of the truck. He eventually admitted that he was driving at the time of the accident and did not have a license, but this was after he provide officers with false information. He was cited for driving with a suspended license, disorderly conduct and leaving the scene of a property damage accident. He was released on I-bond.

Johnny Simmons, 72, 129 Rice St., Bellwood, was arrested and charged with driving under the influence of alcohol after police pulled over his black Toyota Avalon for improper lane use on Myrtle between North and Second at 9:27 p.m. Jan. 6. He was released on I-bond.

Joseph R. O'Brien, 19, 459 Highview, was arrested and charged with DUI after police received a report of a suspicious vehicle on Poplar at 12:09 a.m. Jan. 7. Police said they found O'Brien sitting in a black Cadillac CTS in the driveway of a home where he did not live. He reportedly was not cooperative, would not get out of the vehicle and began fighting with the officer. In addition to DUI, he was charged with obstructing a peace officer, resisting arrest and consumption of alcohol by a minor. A passenger, Samantha Luke, 19, 487 Arlington, was charged with consumption of alcohol by a minor. They were released on bond.

Keith R. Szynal, 35, 1541 N. Coloma Court, Wheaton, was arrested and charged with DUI after police pulled over his silver Hyundai Tucson for driving without headlights and entering where a "do not enter" sign was posted at 2:09 a.m. Jan. 7 at York and First. He also had an expired drivers license and no insurance. He was released on I-bond.

Adam M. McVey, 33, 225 E. First St. Apt. 1, Elmhurst, was arrested and charged with DUI after police pulled over his black Honda Civic for driving on the wrong side of the road at Arlington and St. Charles at 2:01 a.m. Jan. 8. McVey also did not have insurance. He was released on bond.

Jordan P. Cirone, 23, 183 N. Geneva, Elmhurst, was arrested and charged with DUI after police pulled over his red Ford Escape for disobeying a traffic control device at 4:37 a.m. Jan. 8 at North and Michigan. He was released on bond.

Possession of Cannabis

Halie A. Maxwell, 19, Nicholas Ivan Kutscher, 18,  and Thomas A. Lindal, 19, all of 190 S. Prospect Ave., Elmhurst, were arrested and charged with possession of cannabis after police pulled over their green Nissan Maxima at 11:58 p.m. Jan. 8 at Elm and Third. Maxwell and Lindal also were charged with possession of drug paraphernalia. They were released on bond.
