Garage Door Serviceman Receives $4.16 Million in Personal Injury Lawsuit Against Elmhurst

Attorney says verdict is "record-setting."

A 29-year-old who suffered a debilitating fall from a forklift platform at the Elmhurst Public Works garage was awarded $4.16 million Friday in a personal injury lawsuit against the city, news sources are reporting.

Joshua Jaeger suffered severe back and leg injuries in 2009 when he fell 16 feet onto concrete from a city forklift as he was providing an estimate for a broken garage door, according to a Monday article in the Beacon News.


Jaeger's attorney is Joshua Weisberg of Rapoport Law Offices in Chicago. A profile on the firm's website states Jaeger's verdict is "record-setting."

Jaeger received $1.86 million for lost earning capacity, $1.3 million for pain and suffering and $1 million for loss of a normal life.

Was it a faulty scissor lift, or was he lifted up by a forklift and fell off? 4.16 is a lot to pay for preventable stupidity.

The Beacon News article says he was on a platform on the forklift, and an Elmhurst employee raised him up. "As Jaeger moved from one side of the platform to the other, the platform fell to the ground, and Jaeger fell to the concrete floor below." Sounds like a faulty or un-secured platform, but I don't know much about forklifts.

Did someone get fired over this incident....like the worker involved and the supervisor who clearly didn't provide either the appropriate saftey training or the appropriate supervision? Isn't somone that high (on any kind of lift) supposed to be tethered? Where is the accountability?

I agree with you but I don't know if we as just citizen's can do anything to stop that practice. IRead More wish that each cyclist had to have a license, and that it was enforced by laws and police, on the bike so that people could report occurrences and have the person receive a ticket just like a person driving an auto. That would make sense.

I was really hoping that the Elmhurst Police would sound in on this info-I do understand kids willRead More be kids, but if one of them is hurt, that adult driver will need to live with that for the rest of their life-so let's come up with a solution for both bicyclist and cars to be in harmony. I really think that a step up in enforcement in the bicycle laws would help-just like the drunk driving laws-believe me the bicycle laws are just as important.
